1 - General

1-1 - Unless otherwise stipulated, the orders which are placed on our website www.meteo-shopping.fr are subject to the present general conditions of sale, which prevail over any conditions of purchase. The present general conditions of sale apply to the entirety of the services provided by Météo Shopping.

1-2 - Only orders placed by the customer via our website www.meteo-shopping.fr, by email to contact@meteo-shopping.fr or by telephone will be taken into account, subject to written confirmation by the customer.

2 - Prices and deadlines

2-1 - The prices are based on the tariff in force on the day of submission of the offer.

2-2 - Orders are generally delivered within 24 to 72 working hours, except for products not immediately available and for deliveries outside mainland France. More information on delivery times here.

2-3 - The delivery times are indicated on the product sheets, in accordance with the law n° 2008-3 of January 3, 2008 for the development of the competition to the service of the consumers known as Chatel law, Météo Shopping will accept any cancellation of order on behalf of a customer if this one would not be dispatched at the date indicated, except case of absolute necessity: bad weather, natural disaster, etc... The refund of the order will be made within 7 days.

2-4 - Invoices are normally sent by post with the package shipped or separately if the billing and delivery addresses are different.

3- Delivery

The customer will have to check the state of the parcel at the time of the delivery and to indicate the remarks or complaints on the delivery order, the customer will also have to contact Météo Shopping under 48h to inform him of the noted problems.

4 - Terms of payment

4-1 - Payments are without discount and are due at the time of the order on www.meteo-shopping.fr unless otherwise stated in our offers, order confirmations or invoices.

4-2 - Any payment not made on the agreed date to our billing address shall bear interest at the rate of 1% per month without prior notice of default being required.

4-3 - The method of payment in force is the transfer, the bank check or the payment by bank card via the device Sogenactif of the bank Société Générale. Any other method of payment requires the prior agreement of Météo Shopping. More information on payment methods here.

5 - Transfer of ownership

The transfer of ownership of the product sold or the work carried out is subject to full payment of the price.

6 - Right of withdrawal

You have the right to withdraw from this contract without giving any reason within fourteen days. The withdrawal period shall expire fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last item.

Exercising the right of withdrawal

To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (e.g. letter sent by post or e-mail) by post to the address JD ENVIRONNEMENT, 1 rue des peupliers 56490 SAINT MALO DES TROIS FONTAINES, FRANCE or by e-mail to the address contact@meteo-shopping.fr.

You can use the model withdrawal form but this is not obligatory.

In order for the withdrawal period to be respected, it is sufficient that you send your communication on the exercise of the right of withdrawal before the withdrawal period expires.

Consequences of the right of withdrawal

You will have to send back or return the good, to JD ENVIRONNEMENT, 1 rue des peupliers 56490 SAINT MALO DES TROIS FONTAINES, FRANCE, without excessive delay and, in any case, at the latest fourteen days after you will have communicated to us your decision of retraction of the present contract. This period is deemed to have been respected if you return the goods before the expiry of the fourteen day period.

You will have to bear the direct costs of returning the goods.

If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for any additional costs arising from the fact that you have chosen a delivery method other than the cheaper standard delivery method offered by us) without undue delay and in any event no later than fourteen days from the day we are informed of your decision to withdraw from this contract. We will make the refund using the same method of payment as you used for the original transaction, unless you expressly agree to a different method; in any event, there will be no charge to you for the refund. We may defer the refund until we have received the goods or you have provided proof of dispatch of the goods, whichever is the earlier.

You shall only be liable for any depreciation in the value of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods.

Exception to the right of withdrawal

The exercise of the right of withdrawal is excluded for the following contractsµ
- contracts for the supply of goods made to the consumer's specifications or clearly personalised
- contracts for the supply of goods likely to deteriorate or expire rapidly
- contracts for the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;
- contracts for the supply of audio or video recordings or computer software where the seal has been broken by the consumer after delivery;

7 - Guarantees and responsibilities

7-1 - The entrusted works are carried out in the best conditions that allow the technologies used by our company and the indications or originals provided by the customer.

7-2 - Météo Shopping is held only to an obligation of means. Consequently Météo Shopping commits itself to implement, with regard to the current state of its technical means, and to the price paid by the customer and the general circumstances of the mission, the reasonable means to reach a result as reliable as possible.

7-3 - The results of the work are exclusively reserved for the use of the customer of Météo Shopping. Météo Shopping will implement all the necessary precautions for the storage and the conservation of the works until their delivery to the customer. After the delivery of the work to the customer, it cannot be held responsible for the loss or destruction of a file.

7-4- The products sold on our site are generally guaranteed for 2 years, parts and labour. The warranty covers the cost of parts and labour. The return of products to the after-sales service must first be the subject of a written request by e-mail in order to allocate an after-sales return number. Packages without an RMA number will not be accepted.

The replacement of parts does not extend the initial period. The warranty does not apply in case of :

Abnormal wear and tear
Neglect
Lack of maintenance
Misuse
Modifications made by the customer

On weather stations, especially in case of :

Installation of the outdoor sensors (ISS) in the vicinity of a chimney, boiler outlet or kitchen hood (the warranty will be void if the sensors or the station itself shows traces of smoke or grease)
Traces of agricultural or arboricultural treatment products
Traces of liquids (coffee, tea, various liquids, etc.), tobacco smoke, dust or excessive dirt on the console, etc.
Traces of interventions (dismantling) on the console and the external sensors...

8 - Limits of liability

In any case, the responsibility of Météo Shopping will be limited to the price paid by the customer.

9 - Privacy

Météo Shopping will make all reasonable efforts to keep confidential the information which will be entrusted to him within the framework of the work carried out for the customers and the purchases carried out by the customer.

10 - Force majeure

Météo Shopping shall not be liable for any errors or damages or for any other failure to perform its obligations in the event of force majeure which includes for example acts of war, strikes, equipment failure, etc...

11 - Miscellaneous

11-1 - No modification of these general conditions of sale will be valid if it was not the subject of a writing between Météo Shopping and the customer.

11-2 - The possible nullity of a part of the provisions of the present general conditions of sale will not be able to affect the validity of the other conditions.

11-3 - The non-application by Météo Shopping or by the customer of the rights specified in these general conditions of sale could not constitute a renunciation of these rights.

12 - Applicable law / Jurisdiction

12-1 - Any dispute relating to an order received by Météo Shopping will be judged by the Commercial Court of Vannes or before the civil jurisdiction of the place where the defendant is located or before that of the place of effective delivery of the order.

12-2 - No acceptance in payment of cheques, drafts or bills of exchange domiciled in another place shall operate as a derogation or novation to this clause attributing jurisdiction. The applicable law is French law.

13 - Data Protection Laws

Météo Shopping is declared to the Commission Nationale de l'Informatique et des Libertés (CNIL) under the number 1585939.
In accordance with the law n°78-17 of January 6, 1978, any person can obtain correction or suppression of the data relating to it, by addressing an email to contact@meteo-shopping.fr or by mail to JD ENVIRONNEMENT - 1 rue des peupliers 56490 Saint Malo des trois fontaines.

Météo Shopping is committed to preserving the private life of its customers and will not use the personal information communicated to it for any other purpose than to improve the site and the service provided.
